I have a had a mortgage with the infamously awful SPS (Select Portfolio Servicing) ever since their law suit they have been impossible to work with. They put me in foreclosurebeacuse I couldn't keep up with all the penalties that upon me and were to delete from my account after they were sued. Long story short we were working out a buy out plan and there was a sheriff's sale scheduled for 26Sep05. They postponed the sale and did not inform me or my lawyer of the new sale date. They postponed it so that the underwriting team could review the offer to purchase and we could get the situation closed. Come one week later 03Oct05 I found out on accident that they had sold my house at sheriff auction at 9am that morning. Here is the kicker, SPS bought the house for the same amount as we were offering. I never heard back from SPS on the status of the repayment buy out until after they already purchased the house. Any ideas of how I can get my home back?

About a two years ago the bank was about to forclose on my home in the costa del sol, Spain. In an act of deperation, I found an investor who was willing to lend the money to allow us to pay off our mortgage and stay in our home. Last year I found out that I had actually sold my home to him with an option to purchase it back within a year at an agreed price. I thought this was a loan, but found all this out when I appointed another lawyer to deal with it, after I was unhappy with the previous one. It turns out I was misadvised and due to language barriers did not understand the contract I was entering into!

I am now in a position where the previous 'lender' has now got a court order to remove me from my home and this will happen at some point within the next couple of weeks. Can anyone suggest a way I can buy my home back ????(i have no assets to secure a loan on). I am looking for an investor who would be willing to purchase the home and allow me to rent buy it back. The amount I have to pay the current owner is 560,000 euros. PLEASE HELP!
